You should note that certain links on the site lead to resources located on servers maintained by third parties over whom we have no control and accordingly we accept no responsibility or liability for any of the material contained on those servers.

Where part of the site contains advertising and other material submitted to us by third parties please note that those advertisers are responsible for ensuring that material submitted for inclusion on the site complies with all legal requirements. Although acceptance of advertisements on the site is subject to our terms and conditions which are available on request, we do not accept liability in respect of any advertisements. The client - the person, business or company to whom copies of CVs are sent and to whom advertising services are provided by the Company under this agreement.

CV - The brief outline (curriculum vitae or résumé) of a Candidate's education, training, skills and employment experience which is sent to the Company by the Candidate for distribution to direct Employers and Recruitment Agencies for the purpose of locating employment.

Candidate - The person to whom the details within a CV refer.

Client - Any person, business or company to whom the Client intends to submit a CV.

General

These Terms are between the Company and the Client, and govern the obligations of both parties during the service of supplying copies of CVs to the Client and publishing advertising material from the Client by the Company. These Terms shall take immediate effect in substitution of all previous Terms relating to the contents hereof, whether written, oral or implied between the Company and the Client. These Terms are deemed to be accepted by the Client upon the application for or opening of an account with the Company for the purpose of receiving CVs and using the advertising services of the Company. No variation or alteration to these Terms shall be valid unless expressly agreed and confirmed in writing by a Director of the Company.

Subscribing to the Service

Prior to the opening of an online account by the Company on behalf of the Client, the Client shall complete the online account registration form. The client will have read and accepted the terms and conditions online and have paid the subscription amount for the client's chosen sign up period. The Company will confirm the opening and particulars of the account via email.

Company's Obligations

The Company shall supply the Client with a username and password which will entitle the client to access their chosen online service. If a Candidate has explicitly requested that his or her details not be made available to the Client, the Company shall not be obliged to do so.

Only copies of CVs which have been received by the Company for distribution to agencies for the purpose of locating employment will be made available to the Client.

The Company shall provide the Client with full use of its advertising services. The Company may, at its discretion and without recourse, modify or withhold any material submitted by the Client for advertising.

Clients Obligations

The Client shall in all respects comply with all statutes, bye-laws, codes of practice and legal requirements to which the Client is ordinarily subject in respect of it's receipt and processing of CVs. The Client shall ensure that it is registered with the Data Protection Registrar if personal details from CVs are to be held on computer equipment. The Client shall use CVs received from the Company for the sole purpose of endeavouring to locate suitable employment on behalf of Candidates in accordance with their wishes.

The Client shall endeavor to keep confidential any personal details contained within CVs or other information received from the Company in accordance with the wishes of Candidates. In particular, the Client agrees that it will obtain the express consent of a Candidate prior to submitting his or her CV to any Client. The Client shall not submit, copy, re-sell, or make available in any way any CVs or other information received from the Company to any person, business or company other than genuine Clients who are recruiting such Candidates for their own employment. The Client will not discriminate between CVs received from the Company and those received directly in such a manner as to be prejudicial against Candidates for whom CVs have been supplied by the Company.

The Client shall pay the fees of the Company as agreed between the Client and the Company.

The Client shall indemnify and keep indemnified the Company against any costs, claims, damages, expenses and liabilities incurred by the Company arising out of the Client's use of information on CVs or the publication of advertising material.

Company's Charges

The Company shall process payments by the Client on line at monthly (or other agreed) intervals detailing the charges payable by the Client in respect of the CVs ,advertising services and credit card processing charges provided by the Company plus Value Added Tax as required by law.

The company shall not be obliged to issue any credit or make any refund in respect of charges relating to the provision of CVs or advertising services to the Client in accordance with these Terms.

Liability

No liability will be accepted by the Company for any delay, costs, expense, loss or damage arising from the failure of the Company to provide copies of CVs or advertising services.

The Client shall satisfy itself as to the accuracy of information supplied by the Company, and shall take up such references as are deemed necessary for this purpose. No liability will be accepted by the Company for any loss or damage arising out of inaccurate, ambiguous or the misinterpretation of CVs or other information.The Client shall satisfy itself as to the suitability, standard of skill, integrity and reliability of Candidates whose CVs are provided by the Company, and shall take up such references as are deemed necessary for this purpose. No liability will be accepted by the Company for any loss or damage arising out of the negligence, dishonesty, misconduct or lack of skill of Candidates.

Cancellation of Account

Either party may cancel, with effect from the first day of the following month, the account for the supply of CVs and advertising services by notifying the other party in writing. Upon the cancellation of the account by any party, the full amount owing to the Company by the Client in respect of previous services shall become payable with immediate effect.

Should the cancellation of the account be due to improper or illegal use of CVs or services by the Client as defined herein, the Company may, at its discretion and without recourse, report such action to the relevant legal and/or professional bodies including the Department of Employment and the Data Protection Registrar.

Enforceability

These Terms shall be governed and enforceable by English law. The invalidity or unenforceability for any reason of any part of these Terms shall not prejudice or affect the validity or enforceability of the remainder.
